In short: a visa refusal can be challenged within 14 days, either to the Ministry of Foreign Affairs or directly at the Administrative Court Sofia-City, and a residence permit refusal goes to the Administrative Court within 14 days.

The Strict 14-Day Deadline

Under the Foreigners Act, every refusal is open to appeal, and the deadline is 14 days from notification. This is strict: once it passes, the refusal can no longer be challenged in court, and your only option is to reapply.

Appealing a Visa Refusal

For a Type D visa refused at a consulate, you have two routes, both within the same 14 days. You can lodge an administrative appeal with the Ministry of Foreign Affairs, and if that fails proceed to court; or you can go directly to the Administrative Court Sofia-City. You do not need to be in Bulgaria to appeal, and the appeal should set out clearly why the refusal was wrong.

Appealing a Residence Permit Refusal

A residence permit refused by the Migration Directorate can be appealed under the Administrative Procedure Code to the competent Administrative Court within 14 days. If the court agrees with you, it usually orders the authority to re-decide, and the authority cannot refuse again for reasons the court has already rejected.

Watch for an Implied Refusal

If the authorities do not decide within the legal time limit, this can count as an implied refusal, and the clock to challenge it starts running even though you have received no letter. Track your deadlines carefully so you do not lose your right to appeal.

Reapplying

You can submit a new application, including while an appeal is pending, though a fresh application after a refusal is examined carefully, so address the original reason fully.

• Weak proof of funds or accommodation.
