Lodge an Objection Within Four Weeks

The first step is to lodge a written objection with the IND within four weeks of the date on the decision. This deadline is strict. You can lodge it yourself, or authorise a representative or your recognised sponsor to do it for you. Address each reason in the refusal letter directly and attach evidence that closes the gap.

How Long the IND Takes

The IND generally decides an objection within six weeks, extendable to twelve, though it can take longer at busy times. If your lawful stay would lapse while you wait, you may be able to request a provisional measure and receive a residence endorsement sticker in your passport so you can remain during the process.

If the Objection Is Rejected

If the IND declares your objection unfounded, you can appeal to the court, and a further appeal to a higher court is possible after that. Alternatively, you can submit a new application, paying the fee again, which is sometimes the quicker route where the original problem is simple to fix.

What Makes a Strong Objection

• Quote the decision and state clearly why you disagree.
• Rebut each refusal ground specifically rather than in general terms.
• Add stronger evidence, for example salary, the employment contract, sponsor details, or proof of funds.
• Submit within the four-week window and keep proof of sending.
