Golden Visa Experts Urge Swift Action as EU Scrutiny Intensifies
Following growing regulatory pressure from the European Union, immigration lawyers and financial advisers are advising wealthy non-EU nationals to act quickly if they intend to benefit from Europe’s Golden Visa and Golden Passport schemes. They warn that delaying applications may result in tighter restrictions and increased costs.
A Lisbon-based immigration lawyer from FiO Legal told Bloomberg, “The message is clear: those who act sooner will be in a better position.”
EU Challenges “Weak Residency Requirements”
The EU Court of Justice has reaffirmed that EU member states cannot issue passports unless an applicant has a genuine link to the country. The court emphasized concerns about programs with minimal residency requirements, such as Portugal’s Golden Visa, which only demands a 14-day stay every two years for investors to maintain their residency. Notably, Portugal also allows citizenship applications after five years, further intensifying EU scrutiny.
Despite the concerns, Pedro Lino, CEO of Optimize Investment Partners, told Bloomberg that he does not believe Portugal’s Golden Visa program is in immediate danger. However, he confirmed that clients are being urged to accelerate their applications in anticipation of regulatory changes.
Golden Visa vs. Golden Passport Programs
Currently, several European countries offer Golden Visa (residency-by-investment) and Golden Passport (citizenship-by-investment) programs. While Golden Visas provide residency in exchange for substantial financial investments, Golden Passports grant full citizenship, raising higher legal and ethical concerns.
EU Commission Pushes for Program Termination
The European Commission has repeatedly called on member states to abolish residency- and citizenship-by-investment schemes, citing their potential links to money laundering, corruption, and tax evasion. These concerns have placed mounting pressure on countries like Malta, Cyprus, and Bulgaria, which have operated Golden Passport programs.
Malta Criticized for Failing EU Obligations
The EU Court of Justice recently ruled that Malta failed to uphold its obligations under EU treaties by offering citizenship without a genuine national link. The ruling followed an earlier opinion by EU Advocate General Anthony Michael Collins, who previously argued that determining nationality remains the sole right of each member state.
Nonetheless, the latest court decision reinforces the EU’s position that citizenship cannot be commodified, and signals a strong push towards greater regulatory alignment on migration and nationality policies across the bloc.
